Terms of Service

By accessing or using MappedMoment's website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

These terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

To use certain features of MappedMoment, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Create an account using valid authentication through Google or GitHub
• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

MappedMoment is a custom map art e-commerce platform. We allow you to:

• Create personalized map designs featuring locations of your choice
• Customize styles, colors, and text for your map artwork
• Save designs to your account for future editing or ordering
• Purchase printed products featuring your custom designs

We strive to display colors and product images accurately, but we cannot guarantee that your monitor's display will perfectly match the final printed product.

All prices are displayed in USD (United States Dollars) unless otherwise indicated. Prices include production costs but do not include shipping, which is calculated at checkout based on your location and selected shipping method.

Payment is processed securely through Stripe. We accept major credit cards, debit cards, and other payment methods supported by Stripe. By placing an order, you represent that you are authorized to use the payment method provided.

We reserve the right to modify prices at any time. Price changes will not affect orders that have already been confirmed.

Custom Products: Because each product is custom-made to your specifications, orders cannot be cancelled or modified once production has begun. Please review your design carefully before completing your purchase.

Order Confirmation: You will receive an email confirmation when your order is placed and another when it ships. Please ensure your email address is correct.

Order Issues: If there is an issue with your order, please contact us within 14 days of receiving your product.

Production Time: Orders typically take 3-5 business days to produce. Production times may vary during high-demand periods.

Shipping: Shipping times vary by destination and selected shipping method. Domestic orders typically arrive within 5-10 business days after shipping. International orders may take 10-20 business days.

No Guaranteed Delivery Dates: While we strive to deliver orders promptly, we cannot guarantee specific delivery dates. Shipping delays due to carriers, customs, or other factors beyond our control are not our responsibility.

Risk of Loss: All products purchased from MappedMoment are shipped by a third-party carrier. Risk of loss and title for products pass to you upon delivery to the carrier.

Because each product is custom-made specifically for you, we generally cannot accept returns or provide refunds for buyer's remorse or change of mind.

We will provide a replacement or refund if:

• Your product arrives damaged during shipping
• Your product has a manufacturing defect
• Your product differs significantly from what was ordered

Claims Process: To request a replacement or refund, you must contact us within 14 days of receiving your order. Please include your order number and photos showing the issue. We will review your claim and respond within 3-5 business days.

Refunds will be issued to the original payment method and may take 5-10 business days to appear on your statement.

Your Designs: You retain all rights to the custom designs you create using MappedMoment. By creating a design, you grant us a license to use that design solely for the purpose of producing and fulfilling your order.

Map Data: Map data displayed on our site and used in our products is provided by OpenStreetMap contributors and rendered using Mapbox. This data is made available under the Open Database License (ODbL). Map tiles and styling may be subject to additional terms from our map providers.

Our Content: All other content on MappedMoment, including but not limited to text, graphics, logos, and software, is our property and is protected by copyright and other intellectual property laws.

Prohibited Uses: You may not use products purchased from MappedMoment for commercial resale or mass reproduction without our written consent.

When using MappedMoment, you agree not to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Create designs containing offensive, illegal, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Use our services to harm others or for fraudulent purposes
• Interfere with the proper functioning of our website

We reserve the right to refuse service and remove any content that violates these terms.

To the maximum extent permitted by law, MappedMoment and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

Our total liability for any claims arising from your use of our services shall not exceed the amount you paid for the product in question.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. We provide our services “as is” and “as available” without warranties of any kind.

You agree to indemnify, defend, and hold harmless MappedMoment and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of our services
• Your violation of these terms
• Your violation of any rights of a third party
• Content you create or submit through our services

These Terms of Service and any disputes arising from your use of MappedMoment shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

Any legal action arising from these terms must be brought in the state or federal courts located in Delaware.

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. We will update the “Last updated” date when changes are made.

Your continued use of MappedMoment after any changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
